Company Law I (formerly Advanced Company Law I) is now an enhanced credit bearing course, bearing credits towards the PG Diploma and LLM (Non-core). It is also still offered as an attendance or competence only course.
Company Law : will consider certain foundational principles of company law. These will form the basis for Company Law II in which selected topics will be considered in more detail. The course is theoretical. It will look at trends abroad and consider whether the South African approach to the topics discussed addresses company law problems in an efficient and theoretically sound manner. Case law will be critically analysed with specific focus on the changes wrought by the Companies Act 61 of 1973, and how the Companies Act, 71 of 2008. The emphasis in this course is on critical thinking around the theory and practice of company law.
Company Registration : A company may be registered with or without a company name. When a company is registered without a name, its registration number automatically becomes the company name. Such a company may transact with a trading (business) name, or may apply to add a reserved name at a later stage.
