Dispute Resolution

Dispute resolution or dispute settlement is the process of resolving disputes between parties. It is a good first step in trying to reach agreement about many kinds of problems, including disputes: between neighbours. The term dispute resolution is sometimes used interchangeably with conflict resolution, although conflicts are generally more deep-rooted and lengthy than disputes. There are many types of dispute resolution processes, but arbitration; mediation; neutral evaluation, settlement conferences and negotiation are the three most common types of alternative dispute resolution.

Possible causes of a conflict are, e.g.:

  • Break-down of communication.
  • Lack of appreciation and respect.
  • Change of economic and commercial circumstances.
  • Differing legal concepts / change in law.
  • Technical problems / defective products.
  • Differing views of underlying facts.
  • Impact of third parties / force majeure.
